How many types of trademarks are there, and how do they differ?
There are 4 types: Trademark, used for goods; Service Mark, used for services; Certification Mark, used to certify quality or standards; and Collective Mark, used by members of the same group or association.
Why check a mark before filing?
Filing without a prior check carries a high risk of refusal because the mark is identical or similar to one already registered — wasting both time and the fees you've already paid. An experienced agent will run a preliminary similarity check and recommend goods/services classes with full coverage.
What happens if my mark is refused?
You can file an appeal or amend the application with the Department of Intellectual Property, but the timeline will extend by several more months to a year. An experienced agent will help assess the right approach based on the grounds for refusal.
How is the trademark registration fee calculated?
The government fee is calculated by the number of goods/services classes filed — the more classes, the higher the fee — plus our service fee, starting from THB 4,900, which depends on the complexity of the search and drafting work involved.
If I register in Thailand, is my trademark protected internationally too?
A trademark only protects you in the country where it's registered. For international protection you need to file separately in each country, or file through the Madrid Protocol system — Patent To You handles both domestic and international filing, so feel free to ask us.
How long does each stage at the Department of Intellectual Property take?
Roughly: Formality Examination 1-3 months, Substantive Examination 8-12 months, opposition publication period 90 days, certificate issuance 30-60 days — totaling about 12-18 months if there are no issues, and potentially extending to 2-3 years if there's an opposition or the application needs amendment.
Which channels can I use to file a trademark application?
There are 4 channels: filing in person at the Department of Intellectual Property, filing at a provincial commerce office, filing by registered mail, or filing online through the e-Filing system — Patent To You handles filing on your behalf through any of these channels, so you don't need to travel yourself.
How long is a trademark protected, and does it need renewal?
A registered trademark is protected for 10 years from the registration date, and can be renewed for another 10 years each time, indefinitely, as long as the mark continues to be used commercially. Always file for renewal before the term expires so the mark isn't removed from the register.
