How is a patent search different from a trademark search?
A patent search checks the novelty of an invention against prior art worldwide, which is more complex than a trademark search, which only compares similarity of names/logos within the country where you're filing.
Does a search result guarantee successful registration?
No, it's not a guarantee. The search result informs the filing decision but does not guarantee that a patent will be granted. The application will ultimately be assessed by the Department of Intellectual Property based on the applicable legal requirements, the claims as filed or amended, and the prior art identified during examination.
Should I search before or after finishing development of my invention?
We recommend searching early in development, to save time and budget if a closely related prior invention already exists — so you can adjust your development direction in time.

What's the difference between Freedom-to-Operate (FTO) and a Patentability Search?
A Patentability Search checks whether your invention is novel enough to be patentable. A Freedom-to-Operate (FTO) search checks whether manufacturing or selling your product would infringe someone else's still-active patent. They serve different purposes, and in some cases both may be needed.
If the search finds a very closely related patent, what should I do?
